    Service Terms

    Last updated: 2 October 2026

These Service Terms apply in addition to the Customer Agreement and govern your use of specific WularData Services. Capitalised terms not defined here have the meanings given in the Customer Agreement. If these Service Terms conflict with the Customer Agreement, these Service Terms prevail for the Service concerned.

    1. Terms that apply to all Services

1.1 Software and licences. You are responsible for holding valid licences for all software you install or run on the Services, and for complying with their terms. Software we supply (including Microsoft Windows Server, SQL Server and control panel licences provided under our service-provider licensing agreements) is licensed to you only for use on the Service with which it is supplied, may not be transferred outside that Service, and ends when that Service ends.

1.2 Documentation. You must use the Services in line with the technical documentation, guides and knowledge-base articles we publish at wulardata.com or through the Customer Portal, as updated from time to time.

1.3 Verification and cooperation. On reasonable request, you must provide information about your use of the Services and Customer Content so that we can verify compliance with the Customer Agreement and the Acceptable Use Policy, respond to a complaint, or identify the source of a technical problem.

1.4 Prohibited content. If we become aware of Customer Content that breaches the Acceptable Use Policy or applicable law, we will notify you and may ask you to remove it. If you do not remove it or disable access to it within 2 business days, we may do so ourselves or suspend the affected Service. We may act immediately, without prior notice, where content is clearly unlawful, poses a threat to the Services or other customers, or where we are directed to do so by a court or government authority, including under Section 69A or Section 79(3)(b) of the Information Technology Act, 2000.

1.5 Accurate information. All information you give us, including during sign-up, KYC verification, orders and requests for additional resources, must be accurate, complete and not misleading.

1.6 Maintenance. We carry out scheduled maintenance on our facilities, network and platforms to keep them secure and reliable. We will give at least 48 hours' notice of scheduled maintenance that is expected to affect your Service, and will schedule it outside Indian business hours where practicable. Emergency maintenance to address security vulnerabilities or imminent failures may be carried out with shorter or no notice. You must apply any updates or take any actions we reasonably require in connection with maintenance.

1.7 IP addresses. IP addresses assigned to you remain our property (or that of the relevant regional internet registry), are not portable, and are released when the Service ends. You must not use IP addresses we have not assigned to you. We may change assigned IP addresses with reasonable notice for operational reasons. You are responsible for maintaining the reputation of the IP addresses assigned to you; if they are listed on spam or abuse blocklists because of your activity, delisting costs may be charged to you.

1.8 Benchmarks. You may run performance benchmarks on the Services. If you publish benchmark results, you must disclose the information needed to reproduce them.

1.9 Associated services. Some Services require you to use other services (for example, a public IP address, a licence or bandwidth). Those associated services are subject to their own Fees and terms.

1.10 Personal data processed by you. Where you use the Services to process personal data of your End Users or other individuals, you are the Data Fiduciary for that data under the Digital Personal Data Protection Act, 2023 and we act as your Data Processor. You are responsible for giving any required notices, obtaining any required consents and processing that data lawfully. We will process it only on your instructions as set out in the Customer Agreement, and will notify you without undue delay if we become aware of a personal data breach affecting it on our infrastructure.

1.11 Backups. Unless you have purchased a backup or disaster recovery Service, the Services do not include backups of Customer Content, and we are not responsible for restoring lost data. Any snapshots or backups we take for our own operational purposes are not a substitute for your own backups.

1.12 Account closure. When your Account or a Service is closed, Customer Content on that Service is permanently deleted on the termination date in accordance with Section 6.6 of the Customer Agreement and cannot be recovered. Storage media are wiped or destroyed according to our standard data-sanitisation procedures before reuse or disposal.

1.13 Promotional credits and offers. Promotional credits, discounts and free trials are subject to the terms stated in the relevant offer, have no cash value, cannot be transferred and expire on the date stated. We may withdraw an offer at any time and may cancel credits or discounts obtained through abuse or multiple accounts.

1.14 Billing currency. Fees for customers in India are invoiced and payable in Indian Rupees (INR). Customers outside India may be invoiced in US Dollars (USD) or Euros (EUR) as stated in their Order. Any bank, currency-conversion or payment-gateway charges are your responsibility.

    2. VPS hosting and cloud servers

2.1 Resources. Virtual servers are provisioned with the vCPU, memory, storage and bandwidth stated in your plan. CPU and network resources may be shared with other virtual servers on the same host; we may limit resource usage that materially degrades service for other customers.

2.2 Self-managed by default. Unless you have purchased a managed plan, you have full administrative access and are responsible for the operating system, software, security hardening and updates on your server. Our support covers the availability of the underlying platform, network and hardware.

2.3 Bandwidth. Bandwidth and data-transfer allowances are as stated in your plan. Usage above your allowance may be charged at our published rates or throttled, as stated in your Order.

    3. Forex and trading VPS

3.1 Forex VPS plans provide hosting for trading platforms and expert advisers. We do not provide trading, investment or financial advice and are not responsible for any trading decisions, orders, losses or missed trades, whether or not caused by latency, downtime or connectivity issues.

3.2 Latency figures we publish are indicative measurements to specific broker servers at the time of testing and are not guaranteed.

3.3 You are responsible for ensuring that your trading activity complies with the laws and regulations applicable to you, including those of the Reserve Bank of India and the Securities and Exchange Board of India.

    4. Dedicated servers

4.1 Ownership. Dedicated server hardware remains our property at all times. You receive the exclusive right to use the hardware during the term of the Service.

4.2 Hardware replacement. We will replace failed hardware components at our cost, subject to the Service Level Agreement. Hardware failures caused by your actions (for example, firmware changes not approved by us) may be chargeable.

4.3 Upgrades. Hardware upgrades are subject to availability and may require scheduled downtime.

    5. Colocation

5.1 Space and power. Colocation Services provide rack space, power and connectivity at the data centre and in the quantities stated in your Order. You must not exceed your contracted power allocation; sustained excess usage will be charged or may require an upgrade.

5.2 Your equipment. You retain ownership of equipment you install ("Customer Equipment") and are responsible for insuring it. Customer Equipment must be rack-mountable, labelled, in good working order and compliant with applicable safety standards. We may refuse or require removal of equipment that poses a safety or operational risk.

5.3 Access. Physical access to the data centre is limited to individuals you authorise in advance through the Customer Portal or by support ticket. Visitors must carry valid government-issued photo identification, follow our site rules and may be escorted. Access is subject to prior scheduling.

5.4 Remote hands. Remote-hands assistance is available on request and charged at our prevailing rates unless included in your plan. We act only on your instructions and are not liable for the outcome of tasks performed as instructed.

5.5 Removal of equipment. You must remove Customer Equipment within 15 days after the Service ends, provided all Fees are paid. We may retain Customer Equipment until all outstanding Fees are paid. If equipment is not collected within 60 days after the Service ends and after we have given you written notice, we may dispose of it, after securely wiping any storage media, and recover our costs.

    6. Domain registration

6.1 Domain names are registered through accredited registrars and are subject to the policies of the relevant registry, including ICANN for generic domains and the National Internet Exchange of India (NIXI) for .in domains. You must provide accurate registrant information.

6.2 You are responsible for renewing your domain names before they expire. We will send renewal reminders as a courtesy, but we are not liable for loss of a domain name that you did not renew in time.

6.3 Registration, renewal and transfer fees are non-refundable once the request has been submitted to the registry.

    7. Web hosting and business email

7.1 Shared web hosting and business email accounts are subject to the storage, mailbox and sending limits stated in your plan. We may limit outbound email to protect the reputation of our mail servers.

7.2 Microsoft Exchange and Microsoft 365 services are also subject to Microsoft's applicable end-user terms.

    8. Backup and disaster recovery

8.1 Backup and disaster recovery Services operate according to the schedule, retention period and recovery objectives stated in your Order. You are responsible for selecting what is backed up and for testing restores periodically.

8.2 We will use reasonable efforts to restore data from available backups on your request but do not guarantee that every backup will be restorable.

    9. IT managed services, AMC and consulting

9.1 Managed services, annual maintenance contracts (AMC), migration and consulting engagements are delivered according to the scope, schedule and deliverables set out in the relevant Order or statement of work. Work outside that scope is chargeable.

9.2 On-site support visits are available in Delhi NCR and the Chandigarh Tricity region. Visits elsewhere may attract travel and accommodation charges.

9.3 You must give our personnel the access, information and cooperation reasonably needed to perform the services. We are not responsible for delays caused by your failure to do so.

    10. Services hosted outside India

Where you choose a data centre location outside India (such as our European location in France), Customer Content will be stored and processed in that country and will be subject to its laws. You are responsible for confirming that hosting your data in that location is permitted for your use case.
